The ruling of the Supreme Courts’ decision on May 4th, was very important for undocumented immigrants, however this was not the case for everyone. Whoever steals and uses someone else’s identification, commits a crime and is condemned to a mandatory sentence of two years in prison, according to a law enacted in 2004. An immigrant charged of this crime, now becomes inadmissible to obtaining permanent residency in the United States.
Someone who utilizes an identification number for work, which is not being used by another person, will not have a major complication as long as their intent is to solely work and pay taxes. Nevertheless, this is not the case for those who possess and present fraudulent documentation, even if they have good intentions to work.
Therefore, if an immigrant decides to work without authorization, they should accept the facts that they are doing so illegally and could be arrested. In order to prevent from being accused with illegal activity, an immigrant should:
1) Obtain an identification number to pay taxes, known as ITIN (Individual Tax Identification Number). This number is granted to immigrants without authorization to work by, the Department of Internal Revenue Service, one of the most important federal agencies of the country which has kept their promise to not report an immigrant who pays their taxes.
2) Never carry, nor present any fraudulent document to a government agency or to an employer to obtain work.
