Fraud and
Falsification (part 2) |
| |
Many immigrants, for not having
the required documentation for their immigration process and for
not being familiar with immigration law, get themselves into a
dead end street. They consult with a qualified professional and
reveal that they committed or might commit an act of fraud or
falsification to obtain their residency; without understanding
that they are making the counselor into their accomplice. In
these cases, the legal representative will protect himself by
not accepting the case and will disassociate himself from it for
fear of losing his license. |

Fraud in
Immigration Cases (part 1) |
| |
Due to the high percentage of fraudulent cases, the
Immigration Service has established and implemented
a program to evaluate the integrity in the granting
of residency and temporary visas. The last
evaluation found that 33% of religious petitions are
fraudulent. Even though, generally Immigration will
consider the immigrant to be at fault, many times
they are the ones who are victims of unscrupulous
individual or organizations that take advantage of
their naiveness. |

Positive Changes!
The Affidavit of Support |
| |
Beginning July 21, 2006, a new regulation that clarifies the use
of the Guarantees of Support came into effect entitled “The
Affidavit of Support”. This new regulation highlights the
importance of this document when applying to be a guarantor or
declaring permanent residency. It also clarifies those who are
exempt from having to sign the guarantee to prove to the
government that the new immigrant will not be a public charge.

The government
accepts the payment of taxes of an immigrant |
| |
Contrary to what many think, all immigrants who enter the United
States as residents are considered unacceptable unless they
prove, among other things, that they will not become public
charge. However, the family members of residents and citizens
should guarantee it with a contract with the government. |
