An immigrant who can obtain a discretionary pardon or exoneration (a waiver), is usually the spouse or child of a citizen or resident, who proves that if their residency is declined it will cause great suffering and extreme deprivation to the citizen or resident. For example:
2.Women and children who come to the U.S. to escape physical abuse.
3.Those who have been deported or expelled more than once.
4.Immigrants who have not appeared before an immigration court, during a deportation proceeding.
5.Certain immigrants who have lied during their procedure.
6.Immigrants who have been restricted to enter the country for 20 years could once again be allowed in.
7. Some immigrants who have been restricted to enter for 5 years due to “aggravated assault”.
8.Undocumented immigrants who have left the country and try to re-enter after an illegal stay of more than 6 months. If the illegal stay lasted more than 6 months, the immigrant will be considered to be inadmissible for 3 years or if the stay was more than 1 year, the immigrant will be inadmissible.
9.Immigrants, with a student visa, who attend public school without authorization, could be exonerated after 5 years of irrevocable inadmissibility.
Foreigners who generally CANNOT obtain exoneration are: Those who have falsely argued to be a citizen of the United States; and immigrants who have committed past criminal acts of a felony that requires more than 1 year in prison or those who have three or more misdemeanors.
