As Christmas approaches, thousands of immigrants with pending residency applications leave the country to visit their loved ones without considering the consequences.
"Everyone who is in the process of residence must obtain a permit of re-entry before leaving the United States"; this has been spread by our media trying to keep our community informed. These members of the media do not know they are providing partial information that does not apply to everyone, and that their recommendations will become the worst nightmare for those that follow it without professional advice.
Undocumented immigrants in the process of residence under section 245i, whom are allowed to stay in the United States, may apply for and obtain an immigration permit to leave and enter legally. But although they have obtained the permit properly when they go to their final appointment to get their residence they might be placed in limbo unimaginable, denying his residence for having left his place of residence after being continued for more than six months or a year, as undocumented.
As a result, thousands of immigrants were placed in deportation proceedings, expelled from the country and condemned to being unable to return for more than 10 years. Section 245i of the Immigration Act allows at this time, obtaining residency to those who began their case before April 30, 2001, provided they continue to be eligible and have not left the country, among many other restrictions.
The only exceptions are those with parents and spouses citizens may apply for a waiver.
Again, my recommendation is contrary to several media reports, that not knowing fully the existing rules of immigration provide completely erroneous information, which could result in the separation from your family, losing your job and not being able to return to the States United for over 10 years.
Remember that there is always much more to analyze before making a legal strategy.
